1. Definitions

• "Services" refers to Biz Secure Online's subscription software for cybersecurity vulnerability detection and reporting.
• "Customer" or "you" refers to the entity or person creating an account and using the Services.
• "Subscription Term" refers to the monthly period you have paid for.

2. Scope of Services

We provide hosted software for cybersecurity vulnerability detection and reporting to SMEs. Availability is targeted at 99% monthly uptime, excluding planned maintenance and events beyond our reasonable control. No service credits apply.

3. Account Registration & Eligibility

You must provide accurate account information and maintain security of login credentials. If you are a business, you warrant you have authority to bind the organisation.

4. Subscriptions, Fees & Taxes (GST)

Fees are billed in AUD, exclusive of GST unless stated, and are payable in advance each month. Automatic monthly renewal applies until cancelled by the account holder. One calendar month cancellation notice is required.

5. Cancellation

You may cancel with one calendar month written notice, effective at the end of the current monthly term. Automatic monthly renewal continues until cancellation.

6. Your Responsibilities

Use Services lawfully; do not attempt to bypass security or misuse scanning in ways that breach law or third-party rights.

7. Data Protection & Privacy

We comply with the Privacy Act 1988 (Cth) and Australian Privacy Principles. Hosting region is Australia; key vendors include global cybersecurity open-source solutions. See our Privacy Policy for full details.

8. Marketing Communications

We send emails/SMS for registration confirmation, report notifications, user experience and product feature surveys. Newsletter communications require opt-in consent.

9. Intellectual Property

All Service IP is owned by Biz Secure Online or its licensors. You receive a limited, non-transferable right to use the Services during the Subscription Term.

10. Warranties & Consumer Guarantees

Nothing in these Terms excludes rights under the Australian Consumer Law. Services are provided with reasonable care and skill.

11. Limitation of Liability

To the maximum extent permitted by law, liability for failure to comply with a guarantee may be limited to resupplying the Services or paying the cost of resupply.

12. Governing Law & Venue

These Terms are governed by the laws of Queensland, Australia, and the parties submit to the exclusive jurisdiction of the courts of Queensland.
